Terms of Service

1. Acceptance of Terms

By accessing or using the PlotListings website and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

2. Description of Service

PlotListings provides an online marketplace platform that connects buyers and sellers of cemetery plots, crypts, niches, and mausoleum spaces ("Properties"). We are a for-sale-by-owner (FSBO) marketplace and do not act as a broker, agent, or party to any transaction between users. PlotListings does not own, manage, or control any cemetery or Property listed on the platform.

Our role is limited to providing the technology platform, messaging tools, and informational resources to facilitate connections between buyers and sellers. All transactions, negotiations, and transfers are conducted directly between the parties involved.

3. User Accounts

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account.

You must be at least 18 years of age to create an account. Each person may maintain only one account. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for fraudulent purposes.

4. Listings

Sellers are solely responsible for the accuracy and completeness of their listing information, including Property descriptions, photos, pricing, and location details. By creating a listing, you represent and warrant that:

  • You are the legal owner of the Property or are authorized by the owner to list and sell it.
  • The Property is available for sale and can be legally transferred.
  • All information provided in the listing is accurate, truthful, and not misleading.
  • The listing does not infringe upon any third-party rights or violate any applicable laws or regulations.

PlotListings reserves the right to remove any listing that violates these Terms, contains inaccurate information, or is reported by other users, at our sole discretion and without prior notice.

5. Fees and Payments

PlotListings offers a free 30-day trial for new listings. After the trial period, a monthly subscription fee of $14.95 applies to maintain active listings. PlotListings does not charge commissions or take a percentage of any sale price. All fees are non-refundable unless otherwise specified.

We reserve the right to modify our pricing at any time. Any changes will be communicated to active subscribers at least 30 days in advance and will apply at the start of the next billing cycle.

6. Prohibited Conduct

You agree not to:

  • Post false, misleading, or fraudulent listings or information.
  • Use the Service for any illegal purpose or in violation of any applicable laws.
  • Harass, abuse, or threaten other users through the messaging system or otherwise.
  • Attempt to circumvent the platform to avoid paying applicable fees.
  • Scrape, harvest, or collect information from the Service using automated means without authorization.
  • Impersonate another person or entity, or misrepresent your affiliation with a person or entity.
  • Interfere with or disrupt the Service, servers, or networks connected to the Service.
  • List Properties that you do not own or are not authorized to sell.

7. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

PlotListings does not warrant that: (a) the Service will be uninterrupted, secure, or error-free; (b) listings are accurate, reliable, or complete; (c) any transaction between users will be completed successfully; or (d) the transfer of any Property will be approved by the relevant cemetery.

PlotListings is not a party to any transaction between buyers and sellers. We do not guarantee the identity of any user, the legitimacy of any listing, or the outcome of any negotiation or transfer. Users are encouraged to perform their own due diligence before entering into any transaction.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLOTLISTINGS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY TRANSACTION OR RELATIONSHIP BETWEEN USERS; (C) ANY CONTENT OBTAINED FROM THE SERVICE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT OR INFORMATION.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100.00) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless PlotListings and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your listing of any Property; or (d) any transaction you enter into with another user through the Service.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Wilmington, Delaware, and you consent to the personal jurisdiction of such courts.
